DEVANGANA KALITA GETS BAIL IN DELHI RIOTS CASE: DELHI HC

The Delhi High Court on 1st September allowed the bail plea filed by PINJRA TOD activist, Devangana Kalita in the case law- “Devangana Kalita vs. State” related to the Delhi riots. The order was delivered by Justice Suresh Kumar Kait.

Kalita is an accused in 4 FIRs referring to the Delhi Riots and anti-CAA protests. The bail is concerned with Kalita furnishing a personal bond of Rs 25,000 with one surety of the like amount to the satisfaction of the court, if not required in another case. The bail plea has been moved in FIR No. 50/2020 filed at PS Jafrabad for Delhi Riots. She was arrested in May 2020 and is currently in judicial custody at Tihar jail. Kalita’s bail plea was canceled by the trial court in June, 2020.

Kalita had stated that there was no evidence of her presence in violence or rioting and that she was only participating in the protest against the Citizenship Amendment Act. It was also noted that she was not featured in any of the CCTV footage covered by the Delhi Police.

In conclusion, the court said that, since it did not include all the essentials of the prosecution case, the defendant was entitled to bail in the aforementioned case.
